1. Introduction

Welcome to PreCheck ("PreCheck", "we", "us", or "our"). PreCheck is a specialist pre-audit service that reviews pre-building surveys for insulation installers against PAS2030 compliance standards, delivered in partnership with Quality Mark Protection.

These Terms & Conditions ("Terms") form a legally binding agreement between you (the "Customer", "you", or "your") and PreCheck. If you do not agree with these Terms, you must not use our services.

2. Definitions

• Service(s): the pre-building survey review, audit, reporting, and related activities provided by PreCheck.
• Platform: the PreCheck website, portal, and any associated tools.
• Account: the authenticated user profile used to access the Platform.
• Content: any data, files, documents, or information you submit to the Platform.
• IBG: Insurance Backed Guarantee, as issued by Quality Mark Protection or other authorised providers.

3. Accounts & eligibility

To use our Services, you must register an Account and provide accurate, complete, and up-to-date information. You are responsible for maintaining the confidentiality of your login credentials and for all activity performed under your Account.

You must be at least 18 years old and authorised to enter into contracts on behalf of your organisation.

We reserve the right to suspend or terminate Accounts that breach these Terms, contain falsified information, or are used for unlawful purposes.

4. Our services

PreCheck provides independent review of pre-building surveys against PAS2030 requirements and Quality Mark Protection criteria. Our assessments are advisory in nature and are intended to help installers identify and remedy issues prior to installation.

We do not install, specify, or physically inspect insulation measures. Responsibility for the accuracy of survey data and the actual installation remains with the installer.

We make reasonable efforts to deliver reviews within the stated turnaround times but do not guarantee specific timeframes.

5. Fees & payment

Fees for our Services are displayed on the Platform or provided in a written quote. All fees are in GBP and exclusive of VAT unless stated otherwise.

Payment is processed securely via Stripe or another authorised payment provider. You authorise PreCheck and its payment processor to charge the payment method provided.

Unless otherwise agreed, fees are non-refundable once a review has commenced.

6. Customer obligations

You agree to:

• Provide accurate and complete survey data, supporting evidence, and property details.
• Respond to reasonable requests for additional information within a timely manner.
• Ensure that any data submitted is lawful and that you have the right to share it.
• Not misuse the Platform, including attempting to access areas you are not authorised to use.

7. Intellectual property

All intellectual property in the Platform, our Services, branding, methodology, and documentation is owned by PreCheck or its licensors. You are granted a limited, non-exclusive, non-transferable licence to use the Platform solely for the purpose of receiving the Services.

You retain all rights in Content you submit. You grant PreCheck a limited licence to process, store, and use such Content for the purposes of delivering the Services.

8. Liability

To the fullest extent permitted by law, PreCheck's total aggregate liability arising out of or in connection with these Terms shall not exceed the fees paid by you for the specific Service giving rise to the claim during the 12 months preceding the event giving rise to liability.

PreCheck shall not be liable for any indirect, incidental, or consequential loss, including loss of profits, business, goodwill, or data.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

9. Termination

You may close your Account at any time by contacting us at [email protected].

We may suspend or terminate your access to the Services immediately if you breach these Terms, if continued use poses a security or legal risk, or if required by law.

10. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date at the top indicates when the latest revision was made. Continued use of the Services after changes take effect constitutes acceptance of the updated Terms.

11. Governing law

These Terms are governed by the laws of England and Wales. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
